Trucking in New Mexico — what you need to know before you start
New Mexico trucking compliance services keep your operation legal under federal FMCSA rules and the New Mexico Taxation and Revenue Department’s weight-distance tax (WDT) requirements. New Mexico is one of only four states (along with Kentucky, Oregon, and New York) that imposes a separate weight-distance tax on commercial vehicles operating on its public highways.
Every truck with a declared gross weight over 26,000 lbs that operates on New Mexico public highways needs an active WDT permit and credentials. Albuquerque sits at the I-25/I-40 freight crossroads, and Las Cruces near the El Paso/Santa Teresa border crossing into Mexico is one of the fastest-growing border freight markets in the country.
Everything a New Mexico carrier needs — under one roof
We handle all federal and New Mexico-specific filings, including the WDT permit most owner operators don't realize they need.
LLC / Business Formation
Start your New Mexico trucking business with the NM Secretary of State. LLC, Business Tax Assistance, and operating agreement included.
USDOT Number Registration
Filed correctly with FMCSA the same business day. Most DOT numbers are active within 1 to 2 business days.
MC Authority (Operating)
Get your Motor Carrier number from the FMCSA. Required for all interstate for-hire freight crossing state lines.
NM Weight-Distance Tax Permit
New Mexico-specific weight-distance tax credentials from the NM Taxation and Revenue Department. Required for any truck over 26,000 lbs operating on NM highways.
BOC-3 Filing
FMCSA-required for all carriers and brokers. We cover all 50 states and Washington D.C. in a single blanket filing.
IFTA Registration & Filing
We register your IFTA account, issue decals, and file quarterly fuel tax returns. Separate from the NM weight-distance tax.
New Mexico-specific requirements competitors won't tell you about
New Mexico has one of the most distinctive state-specific trucking tax programs in the country. Get the WDT wrong and you're parked at the port-of-entry station.
IFTA Quarterly Fuel Tax
New Mexico is a full IFTA member. Quarterly fuel tax reports for every state you operate in. Note: IFTA does NOT cover the WDT — that is a separate New Mexico filing.
Weight-Distance Tax (WDT) Permit
Required for any truck with declared gross weight over 26,000 lbs operating on NM public highways. Per-mile tax filed quarterly with the NM Taxation and Revenue Department. Out-of-state carriers can use trip permits for occasional trips.
NM Port-of-Entry Inspections
New Mexico operates active port-of-entry inspection stations on every major border highway. Trucks without valid WDT credentials are stopped, ticketed, and held until permits are obtained. WDT enforcement in New Mexico is among the strictest in the country.
NM Biennial Report (LLCs)
New Mexico LLCs were historically not required to file annual reports, but corporate entities must file biennial reports with the NM Secretary of State. Trucking corporations need to track this filing to stay in good standing.
Why New Mexico is one of the best states to start a trucking company
New Mexico combines border freight access from Las Cruces/Santa Teresa, Southwest freight gateway status, and reasonable LLC costs — strong fundamentals for owner operators serving the US-Mexico trade corridor.

New Mexico trucking compliance — frequently asked questions
Starting a trucking business is not just about knowing how to drive. It is about building a legal, compliant operation that brokers will load, banks will fund, and the FMCSA will not shut down.
The New Mexico weight-distance tax is a per-mile road-use tax on commercial vehicles over 26,000 lbs declared gross weight. The NM Taxation and Revenue Department issues the credentials. You need a permanent WDT account if you operate in NM regularly, or trip permits for occasional travel. Failing to register triggers fines starting at $250 per violation.
. No. IFTA covers fuel tax across IFTA member states. The WDT is a completely separate New Mexico per-mile tax. You file IFTA quarterly to cover fuel taxes, and you file WDT returns separately for the per-mile tax. Both are required for qualified vehicles.
Permanent WDT accounts typically take 5 to 10 business days to set up. Trip permits for occasional NM travel can be issued same day. Out-of-state carriers passing through New Mexico usually use trip permits rather than setting up permanent accounts.
An LLC is not federally required, but a New Mexico LLC is strongly recommended. It separates your personal assets from business liability, lets you open a business bank account, and is required by most lenders, factoring companies, and shippers. We file New Mexico LLCs with the NM Secretary of State the same business day.
Not legally without a trip permit. Any qualified truck operating on New Mexico public highways needs either a permanent WDT account or a temporary trip permit. New Mexico’s port-of-entry stations are among the most active in the country, and trucks without credentials are stopped immediately.
If you operate a qualified vehicle (26,001+ lbs or 3+ axles) across state lines, you need IRP apportioned plates issued through the New Mexico Motor Vehicle Division. The plates let you operate in all participating jurisdictions under one registration. We coordinate IRP setup with your IFTA, WDT, and DOT registration.
